Privacy Policy & Terms of Use

This Privacy Policy and Terms of Use ( the “Policy”)  explains how the Cryptoasset and Blockchain ISAC, Inc. DBA Crypto ISAC (“we”, “us”, “our”, “the ISAC”) collect, use, and maintain the personal information of our users and website visitors (“you”).  It also sets forth your obligations with respect to your use of this website (the “Site”). 

By accessing or using the Site, you agree to abide by the terms of this Policy, and to our collection, use, and maintenance of your personal information in accordance with this Policy. If you do not agree to this Policy, you should not use this Site or otherwise provide us with your personal information. 

Information We Collect and How We Collect It

We collect several types of information from and about users of our Site, including:

  • Personal information about you, including contact information, such as your name, job roles, affiliations, postal and email addresses, or any other information required to process a request you have made to us. We collect this information when you provide it to us;

  • Information that is about you but does not individually identify you, such as any alias, username or screen name you may create to post on the Site. We collect this information when you provide it to us; and

  • Information about your internet connection, IP address, the device you use to access our Site, and usage details. As you interact with the Site, we may use automatic data collecting technologies to collect this information.

If you contact us, we may keep a record of your correspondence, including any information contained therein. You may update or correct any of the personal information that you have provided to us by sending an email to privacy@cryptoisac.org

How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information:

  • To present our Site and its contents to you;

  • To provide you with information or services that you request from us;

  • To notify you about changes to our Site or any content or services we offer or provide though it;

  • To allow you to participate in interactive features on our Site; and

  • For any other purpose with your consent.

Disclosure of Your Information

We will not disclose any of your personal information to third parties, except (i) to our affiliates, agents, consultants and sub-contractors in connection with the operation of the ISAC; (ii) to certain established third party vendors that perform services for us in connection with the operation of our Site (for example, vendors who assist us in operating any community network service associated with the Site, sending postal mail and e-mail, and analyzing data or other administrative tasks) or provide other services to our Organization; (iii) when we believe that such disclosure is required by law; (iv) to enforce or apply this Policy; (v) when we believe such disclosure is necessary or appropriate to protect our rights, property, security or safety, or that of the public; (vi) as otherwise stated in this Policy; or (viii) otherwise at your request or with your express permission.

When we share information with these third parties, we seek to limit such sharing to the extent possible, and to ensure that such third parties will use the information solely for the purpose of providing services to us and in accordance with this Policy. 

Use of Cookies and Other Tracking Technologies

Cookies are small pieces of data, stored in text files, that are stored on your computer or other device when you load websites in a browser. Cookies are widely used to “remember” you and your preferences, either for a single visit (“session cookie”) or for multiple repeat visits (using a “persistent cookie”). While we currently do not use cookies on our Site, we may decide to use them in the future. In the event we do decide to use cookies on any Site, we may do so for a number of purposes, such as maintaining continuity during a user session, to gather data about the usage of our Site for research and other purposes and to enable our servers to recognize your computer so that your preferences and/or authentication credentials can be recognized so that you do not have to provide this information every time you return to our Site. You can decide if and how your computer will accept a cookie by configuring your preferences or options in your browser. However, if you choose to reject cookies, you may not be able to use certain of our Site’s features. We may occasionally use other companies to set cookies on our Site and gather cookie information for us. We will use the cookie information gathered by these companies in the same manner as stated above.

How Your Information Is Protected

We strive to protect all information we collect, use, and maintain from loss, misuse or alteration. We maintain reasonable physical, electronic and procedural safeguards designed to secure your information. 

You should recognize, however, that there is no such thing as “perfect security” on the internet, and we cannot guarantee the security of your personal information. In addition, because internet communication is unsecure, it is possible that the information you supply to us via this Site will be intercepted during transmission. While we strive to protect your information to the best of our ability, we cannot be liable for any breach of our systems or interception of our transmission and hereby disclaim, to the fullest extent provided under law, any liability associated with any claim relating to a breach of security, data, or information.

Other Communications

From time to time, we may e-mail you with information regarding important developments affecting the ISAC. We may also e-mail you on occasion regarding the Site. Such e-mails may be sent to you even if you have not requested to receive any communication from us.  You may opt-out of such email communications by contacting us at the email address below, or by clicking the “unsubscribe” link in the email.

Links to Third-Party Sites and Sources

The Site may contain links to websites owned and operated by third parties, as well as citations to information published elsewhere. The availability of such links or services and our citation to sources on the Site does not signify that we have any association with such third parties and does not constitute our endorsement of any information, content, products, or services available through such sites or services. Inquiries about such third-party sites or services should be directed to the applicable third parties, and we would refer you to the sources cited for additional information about those materials.  We are not responsible for and have no control over the privacy policies of those sites, nor have we necessarily confirmed the accuracy of the information in cited sources. We encourage you to review the privacy policies of those sites prior to providing them with any of your information. You acknowledge and agree that we are not responsible and will have no liability for any damage or loss in connection with your transactions or interactions with any third parties.

Ownership of Content

All text, images, graphics, sounds,  software code and other content (“Content”) on the Site are copyrighted property of the ISAC, its affiliates or others. No part of the Content shall be made subject to any open source, copyleft, or similar license. You may not reproduce, redistribute, publish or otherwise use by electronic or any other means any of the Content without our prior written consent.

Limitation of Liability

The ISAC and its affiliates, officers, agents, partners and employees shall not be liable for any direct, indirect, incidental, special or consequential damages, resulting from the use or the inability to use the Site and services or resulting from any information or services obtained or messages received or transactions entered into through the Site or resulting from unauthorized access to or alteration of your transmissions of data, including but not limited to, damages for loss of profits, use, data or other intangibles, even if we have been advised of the possibility of such damages. Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in such states liability is limited to the fullest extent permitted by law. If you are dissatisfied with any portion of the Site, or with any of these terms of use, your sole and exclusive remedy is to discontinue using this Site.

Applicable Law

This Policy will be governed by and construed in accordance with the laws of the State of Delaware, without regard to any principles of conflicts of law that would result in the application of the laws of another jurisdiction. You agree that any action at law or in equity that arises out of or relates to any use of the Site will be filed only in the state or federal courts located in New York County and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.

Your European Data Rights

If you are located in the European Economic Area (“EEA”), Switzerland, or the United Kingdom, subject to applicable law, you may have the following rights in relation to personal information that we hold about you. To exercise these rights and controls, please contact privacy@cryptoisac.org.

  • Access: You have the right to ask for a copy of the personal information that we hold about you free of charge, however we may charge a reasonable fee, if we think that your request is excessive, to help us cover the costs of locating the information you have requested.

  • Correction: You may notify us of changes to such your personal information if it is inaccurate or it needs to be updated.

  • Deletion: If you think that we should not be holding or processing your personal information anymore, you may request that we delete it. Please note that this may not always be possible due to legal obligations.

  • Restrictions on use: You may request that we stop processing your personal information (other than storing it), if: (i) you contest the accuracy of it (until the accuracy is verified); (ii) you believe the processing is against the law; (iii) you believe that we no longer need your data for the purposes for which it was collected, but you still need your data to establish or defend a legal claim; or (iv) you object to the processing, and we are verifying whether our legitimate grounds to process your personal information, override your own rights.

  • Object: You have the right to object to processing, including: (i) for direct marketing; (ii) for research or statistical purposes; or (iii) where processing is based on legitimate interests.

  • Portability: If you wish to transfer your personal information to another organization (and certain conditions are satisfied), you may ask us to do so, and we will send it directly if we have the technical means.

  • Withdrawal of consent: If you previously gave us your consent (by a clear affirmative action) to allow us to process your personal information for a particular purpose, but you no longer wish to consent to us doing so, you can contact us to let us know that you withdraw that consent.

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal information (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

If you believe that we have processed your personal information in violation of applicable law and failed to remedy such violation to your reasonable satisfaction, you may also lodge a complaint with the data protection supervisory authority in your country. The hosting facilities for our website and operations are located in the United States. By providing us your data, you consent to its transfer and storage within the U.S.  For the purpose of applicable EU laws, such third countries (including the U.S.) may not offer the same level of data protection as your country of residence. Your Choices Regarding How We Use and Disclose Your Information

You can decide whether or not to accept cookies through your internet browser’s settings. Most browsers have an option for turning off the Cookie feature, which will prevent your browser from accepting new Cookies. You can also delete all Cookies that are already on your device. If you do this, however, you may have to manually adjust some preferences every time you visit our website and some of the services and functionalities may not work. Children Under the Age of 13

Our Site is not intended for children under 13 years of age, and we do not knowingly collect personal information from anyone under 13 years of age. If you are under 13 years of age, please do not use or provide any information on our Site, use any of the interactive features of the Site, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn that we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. How You Can Update or Correct Your Information and Contact the Site

You can email the ISAC at the numbers provided on our Site or send a message to privacy@cryptoisac.org to update or correct your information.   

We may change this Policy from time to time to reflect changed on the Site or in the law.  We encourage you to review this Policy periodically to assure familiarity with the most current version. We will post all changes to the Policy here so that you will always know what information we gather, how we might use that information, and when we will disclose that information to third parties. You can tell that the Policy has been updated by checking the last revised date posted on the top of this page.

If any part of this Policy is determined to be invalid or unenforceable pursuant to applicable law, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of this Policy shall continue in full force and effect.

You agree to accept that any notices we are required to send you will be effective upon the ISAC sending an e-mail message to the email address you have on file with the ISAC, or publishing such notices on the Site. You are responsible for providing us with accurate contact information and we are not responsible for any failure to notify you due to your provision of inaccurate contact information.  

Our failure to exercise or enforce any right or provision of this Policy shall not constitute a waiver of such right or provision.
